RULES AND REGULATIONS OF BRASÍLIA PHOTO SHOW 2018/19

Brasilia Photo Show LTDA, registered at CNPJ 23.955.639 / 0001-26, based in SCRN QUADRA 702/703, BLOCO A, LOJA 47, PARTE AK, BRASÍLIA-DF, also known as Brasília Photo Show, promotes through electronic and physical media the open international festival of photography Brasilia Photo Show, with variable themes.

By submitting your photos to the Brasilia Photo Show festival from March 16, 2018 to July 16, 2018, you will be eligible to win: 1) the publication of your photograph in the book Brasilia Photo Show 2018/19; and / or 2) a printed certificate stating your photo’s final placement; and / or 3) photographic equipment, telephone, book with winning photos and travel voucher, as described in these rules and regulations.

1. PARTICIPANTS

1.1 The festival is open to all professional or amateur photographers from Brazil or abroad, Brazilian or foreigners.

1.2 The participation of persons under 18 years of age is allowed, but only with two free photos, that is, not without access to the paid photos. Those under 18 years of age will also not be able to enter photos in the Sensual Photo category.

1.2.1 In order to participate in the festival, the interested party must fill in all his / her personal data in the registration system.

1.2.2 The use of a third party’s CPF (or ID number) to register in the festival, even if it is by first degree kinship, is prohibited under penalty of disqualification.

1.2.3 Commercial entities and persons professionally bound or by first-degree kinship to members of Brasilia Photo Show are not eligible to participate.

1.3 Participants can submit photographs made by conventional digital camera, cell phone camera, drone or tablet. It must be possible to track the information of the photo and the camera used to take it specifically in the file that will be sent to the festival. The photographic treatment is allowed for accentuation or decrease of brightness, contrast and color, and variation of hue by up to 15%. Photographic editions with artificial coloring, assemblies, overlays and chromatic aberrations must be submitted to the specific category that will have its own awards: Edited Photo / Editing. The organization of the event can designate photos submitted by participants to any category to the most appropriate category.

1.3.1 From 2018, the festival will be divided into categories: photos must be submitted to one of the 16 (sixteen) categories with specific themes. The festival organization may, without prior notice, include, change or delete a category, even if the festival has already opened. If this occurs, the photos entered can be placed in another category.

1.3.2 New Categories:

  1. Cover photo of the Official Book of the BPS 2018/19 Festival – to be chosen from photos submitted to other categories
  2. Best Digital Camera Photo – to be chosen from photos submitted to other categories
  3. Best Mobile Camera Photo – to be chosen from photos submitted to other categories
  4. Best Black and White – to be chosen from photos submitted to other categories
  5. Best Cityscape / Travel
  6. Best Landscape / Adventure
  7. Best Nature (portrait and details) / Animal
  8. Best Photo of Agribusiness / Fruits and vegetables
  9. Best Architecture
  10. Best Portrait of People
  11. Best Astrophotography
  12. Best Sports Photo
  13. Best Journalistic Photo / documentary that has been published in communication vehicle
  14. Best Pregnancy / Babies / Family Photo
  15. Best Wedding Photo
  16. Best Sensual Photo
  17. Best Advertising Photo
  18. Best Edited Photo / Editing (photos with montages, special treatments and editing)
  19. Best Street View Photo
  20. Best Random Photo (photos that do not fit into the above categories)

1.3.3 Likes, comments, and shares on the official festival Facebook page help the jury / curators to interpret the impact, quality, and public appeal of the photos. However, the decision on scoring and awarding of the photos will be exclusive to the organization of the festival, which may ultimately be influenced by public participation or not.

1.3.4 In the official festival page on Facebook it is forbidden to post links for photos in the comments of other participants’ photos. It is also expressly forbidden to use automated systems (robots) to inflate comments and likes, under penalty of disqualification of the photo.

1.3.5 In each of the 16 categories the contest will have 6 (six) finalist photos to compete for 20 (twenty) statuettes.

The 16 (sixteen) winning photographs from each category earn a statuette.

The 2nd place in each category wins a Platinum medal (16 photos).

The 3rd place in each category wins a Gold medal (16 photos).

The 4th place in each category wins a Silver medal (16 photos).

The 5th and 6th place of each category win a Bronze medal (32 photos).

Among the 16 winning photographs of each category, the festival will selected: the best digital camera photo, which will win a statuette with this mention; the best cell phone camera photo, which will win a statuette with this mention; the photo of the cover of the commemorative book of the 2018 edition of the Festival, which will win a statuette with this mention; and the best black and white photo, which will earn a statuette with this mention.

The 304 (three hundred and four) best photos placed shortly after the bronze medals will receive the honorable mention prize.

The authors of the award-winning photos described above will receive their statuettes, awards, and certificates at the annual BPS award ceremony.

All winning photographs of statuettes, medals, and mentions will be printed in the official book of the Festival, which will feature 400 award-winning images.

1.3.6 At the awards ceremony, 6 (six) finalist photos from each of the 16 categories will be announced. These photos will be shown on the event’s screen. An envelope will be open to reveal the winning photo and the image will appear on the big screen as the champion of the category. The author of the winning photo will be called to receive the statuette on the stage. The authors of the other five finalist photographs will receive their respective Platinum, Gold, Silver or Bronze medals, as well as honorable mentions, at the reception of the awards ceremony or by electronic file if their presence is not possible.

1.4 The registration in the festival implies an express and unequivocal affirmation that the participant is the author of the photographs submitted to the system.

2 REQUIREMENTS FOR FESTIVAL PARTICIPATION

2.1 Each participant may submit up to two (2) original / copyright photographs free of charge. From the third photo on, participants must pay a R$ 25.00 (twenty-five reais) fee for each photo, with a maximum of 12 (twelve) photos per participant.

2.1.1 Registration will be made exclusively through the festival’s official website – www.brasiliaphotoshow.com.br, and all conditions of these rules and regulations must be fulfilled as a principle for participation.

2.2 By submitting the photograph, the participant confirms that he / she is the legitimate photographer and owner of all rights over the image submitted, whether moral, patrimonial or copyrighted, and exonerates the Brasilia Photo Show festival from any responsibility.

2.3 All photographs must be entered exclusively in the registration system on the festival’s official website – www.brasiliaphotoshow.com.br, between 7:00 pm on March 16, 2018 (beginning of registration) and 23:59 on July 16, 2018 (Closing of registrations). The initial and final term of the registrations may be changed at the discretion of the organization.

2.4 Publication of the photos on social media and / or the festival website for public evaluation shall be exclusively and strictly limited to the organization of the event. No compliance with this clause may exclude the photograph of the festival even before the public posting, without any reimbursement of amounts paid on registration or any explanation of disqualification.

2.4.1 Photos that may violate Facebook’s internal rules may continue to participate in the Festival if approved by the organization, but will not be posted. This is the case of photos inscribed in the sensual category or artistic nude photos.

2.5 By submitting photographs, the participant confirms that the images will NOT contain:

2.5.1 Recognizable persons, unless he/she can demonstrate in writing that the persons have granted all necessary authorizations for the use and publication of the photographs by Brasilia Photo Show, organizer of the event, by presenting a signed image right license, except for photos competing in the journalistic / documentary / street view categories; or

2.5.2 Works of art, unless he/she can present a written authorization for the organizer of the event to use and publish those works of art, under the terms and conditions of the authorization to use the photographs referred to above; or

2.5.3 Logos or brand names, unless he/she can present a written authorization for the organizer of the event to use and publish those logos or trade names, under the terms and conditions of the authorization of use of the photographs referred to above; or

2.5.4 Images containing scenes that may be considered obscene, immoral or improper, or images that incite violence, or in any way detrimental to morals;

2.5.5 Any characteristic that may violate the rights of third parties;

2.5.6 Signatures and names of authors shall not be placed on the images. The authorship of the photograph will always be associated with the author of the work and exposed in a standardized way by the organization of the festival, not being allowed the placement of the name or any brand in the image submitted.

2.5.7 Submitted photos that fit the analysis of the organization of the festival in items 2.5.1, 2.5.2, 2.5.3, 2.5.4, 2.5.5 and 2.5.6 will be automatically disqualified without prior notice and without any reimbursement of amounts paid at registration or any explanation for the disqualification. The photos disqualified or canceled by the author himself cannot be replaced in any case.

The image use authorization referring to the submission of a photo must be sent immediately after the submission of the photo, via the registration system, since the first stage of moderation will happen at any time. The authorization will only be valid for one photo, that is, even if it is the same person in all the photos entered, it will be necessary to send one authorization per photo. Brasilia Photo Show is not responsible for false image use authorizations.

2.6 By submitting a photograph to the Festival, the participant grants to Brasilia Photo Show, its sponsors and commercial supporters, a non-exclusive, irrevocable and unlimited license to reproduce, enlarge, publish or display his/her work in any media, electronic or printed, social, commercial or philanthropic, for an indefinite period, in Brazil or in any other country, and may not imply any liens, author or patrimonial, for Brasilia Photo Show.

2.6.1 In any situation, the credit to the author of the photograph will be exclusive and perennial.

2.6.2 The participant agrees that the subtitles of the event may be created by the organization of the event, alluding to his photograph in printed or electronic publications.

2.6.3 The participant agrees that the internet is a means of public communication and that the works on display are subject to unauthorized copying, exempting Brasilia Photo Show from any damages arising from unauthorized displays of the images entered in the festival by third parties, except in the cases provided for in these Rules and Regulations.

2.6.4 The participant can register their photo in Brasilia Photo Show even though they are registered in other competitions. However, the regulations between the contests cannot be conflicting with regard to the assignment of image use rights. By submitting the photo to the festival, the festival organization understands that the image use rights license to Brasília Photo Show is valid and authorized by the participant, even if the photo is participating in other events.

2.6.5 The participant understands that the submitted photograph may need treatment for its electronic exhibition, printing or publication, authorizing from now on Brasilia Photo Show and its partners such make such changes as necessary.

2.7 The participant agrees that Brasilia Photo Show will have worldwide right to disseminate his/her name and contacts, user name, photograph and content, in publicity campaigns by means of printed or digital media to divulge the festival indefinitely, without determination of any pecuniary consideration by Brasilia Photo Show or its partners.

2.8 The participant agrees to have his/her name linked to the Ranking of Brasilia Photo Show score.

2.9 When registering in the Festival, the participant agrees to be contacted by Brasilia Photo Show for the purpose of managing the event, and therefore, to keep his data always updated.

2.10 The participant authorizes the disclosure of his / her e-mail along with the photo, when pertinent.

2.11 Brasilia Photo Show reserves the right to disqualify entries that are incomplete, ineligible or that otherwise do not comply with the aforementioned requirements, without any reimbursement of amounts paid in the registrations or any kind of explanation for the disqualification.

2.12 The participant must keep copies of the images submitted in his/her personal files. Brasilia Photo Show will take all reasonable steps to ensure the safe storage and backup of files within the festival deadline, but will not be held liable for exceptional circumstances in which the file may be damaged or deleted.

3 PHOTO SUBMISSION, VOTING, SELECTION, NOTIFICATION OF WINNERS, AWARDS

3.1 To register in the festival, the photographs must be sent to the electronic address www.brasiliaphotoshow.com.br. The file must be properly identified with the name of the photo and the place where the photo was taken, in the context of the photo’s submission to the festival. The photo sent by the participant must be digital and JPG extension, be at least 300KB and at most 15MB and maximum size of 6000 × 8000 pixels. The image, which will be adjusted to the presentation media by the event organization if necessary, cannot contain any watermark, copyright, name or date. Sources of electronic photo information should be preserved for evaluation. The more quality the file has, the better chances the image will get. Photographs and captions will be analyzed by the event organization and will or will not, depending on the analysis, be classified for public viewing on the Internet.

3.2 The publication of the photographs on the internet, website and / or social media will be done according to the convenience of Brasilia Photo Show, and the participants do not have any rights to complain about the date of publication in the electronic communication channels or about possible damages resulted from public analysis.

3.3 At no time shall the organizers be liable for any problems, faults or technical operations of any kind in computer networks, servers or suppliers, computer equipment, hardware or software, or any error, interruption, defect, delay or failure in operations or transmissions for the correct processing of the participations, due to technical problems, congestion or interruption of the internet or social media, including restrictions of postings of companies administering social media, viruses, bugs, or even hackers.

3.4 The 400 best photos will be awarded with their publication along with the proper credit to the authors in the book Brasilia Photo Show 2018, as well as inserted in the website of the event, in the galleries: Olympus – winners of statuettes; Illuminated – Platinum medal winners; Notable – gold medal; Brilliant – Silver medal and; Winners – Bronze medal and; Promisor – winners of Honorable Mention.

First placed participants from each of the 16 categories (from 05 to 20) will receive the prizes according to the descriptions below:

.A statuette

. A travel credit in the amount of R$ 1,000.00 (one thousand reais) to be used exclusively with travel packages in Brazil in low season according to availability. This letter of credit will be valid for 01 (one) year since the awards ceremony that will take place in November / 2018 (day to be determined). In no case will the letter of credit be converted and paid in cash to the winner.

. A copy of the official BPS 2018/19 festival book (noting that in case the author has more than one prize winning photo, he/she will only receive one copy of the book).

3.4.1 The delivery of books and certificates to the respective winners is conditioned to the presence of the participant in the awards ceremony. If the author is not present and wants to receive the award through delivery, he must pay the respective shipping costs or appoint a representative to receive the prizes in his place in the event.

3.4.2 The 400 best ranked participants will be invited by e-mail to receive the Certificate of the Brasilia Photo Show 2018/2019 Festival and the prizes described in these rules and regulations to be physically given at the official party that will be held in November/2018 in Brasília/DF, Brazil. For organization purposes, the finalists and winners of honorable mentions must confirm their participation in the awards party up to 45 (forty-five) days before the event. Brasilia Photo Show may or may not offer invitations to winners’ guests for free or not, depending on the capacity of the space designated for the awards party and the number of confirmations.

The 400 photos will be published in the official book produced in large format and special paper divided into 06 galleries as follows:

Olympus – Statuette (16 photos) being 01 per page,

Illuminated – Platinum (16 photos) being 01 per page,

Notable – Gold (16 photos) being 01 per page,

Brilliant – Silver (16 photos) being 01 per page,

Winners – Bronze (32 photos) being 02 per page,

Promisor – Honorable Mention (304 photos) and 08 per page

The photos will be published, with the proper copyrights, in the official book of the Brasilia Photo Show 2018/19 festival, which will be distributed free of charge to cultural agents and marketed in bookstores, shops, exhibitions and on the internet. The participant, from now on, agrees and declares that he / she will not have rights or financial participation in the results.

The organizer reserves the right to change the layout of the official book according to need, such as quantity of photos per page, book size, number of pages, technical specifications.

3.4.3 The author of a medal-winning photo who cannot attend the event must request to be sent the electronic file of the certificate equivalent to its classification free of charge, by e-mail, within a period of up to thirty (30) business days after request.

3.4.4 Brasília Photo Show may award the “Master Piece Brasilia Photo Show 2018” prize, which deals with a plate of recognition in material and design to be determined at the time of making, for any of the photographs selected for publication in the official book of the event. The number of “Master Piece Brasília Photo Show 2018” prizes granted will be according to the convenience of the organizers.

3.5 A participant may win, be a finalist or medalist in more than one category.

3.6 The winners of the festival will be contacted by email until September 30, 2018, at which time they will be asked to accept their prizes before the public announcement of the winners in each category. This date may be revised, at the discretion of the organization of the event.

3.7 If the chosen winner does not respond within the deadline indicated in the e-mail, Brasilia Photo Show reserves the right to revoke the prize and to select another winner according to its exclusive criteria.

3.8 If the products specified for the awards are not available for any reason, Brasilia Photo Show reserves the right to offer alternative prizes, including other brands, of equivalent or higher value, in its sole discretion. In no case cash will be awarded as an alternative to the material prizes.

3.9 The publication, selection and disclosure of the winners are exclusive responsibility of the Brasilia Photo Show, and no participant shall complain about the dissemination of the images, length of stay in the media and the result ascertained.

3.10 Prizes and certificates shall be delivered to winners at the awards ceremony of the festival in November 2018 for registration and disclosure of the winners. If the participant is unable to attend the ceremony, he/she will have to pay all the costs related to the sending of the prizes to the destination informed. This request must be made by e-mail to comercial@brasiliaphotoshow.com.br, along with the personal data, name of the photo, medal, address and zip code of the place of delivery to the freight quotation after the celebration of the awards ceremony. The sending of the printed certificate will be done after sending the proof of payment of the costs for the sending. Shipping will begin 20 working days after payment confirmation.

The distribution and delivery of prizes and certificates at the party will be determined by Brasilia Photo Show according to the number of confirmed winners, physical space and time available for the awards event. All costs of lodging, transfer, transportation, feeding among others will be the responsibility of the participants, winners or not.

3.11 Brasilia Photo Show may or may not promote the public or private display of the winning photographs in the city of Brasilia or in other locations, and may do so at any time.

3.12 Other prizes may be included by the organizer and there is no need to communicate to the participants.

3.13 The organizer may, without prior notice, increase or decrease the number of winners, designated finalists and categories.

4. PRIVACY POLICY

4.1 The personal information sent by the participant will be used by Brasilia Photo Show to carry out the festival and for the publication of data of the authors to subjects related to registration, awards, exhibitions, and electronic and printed publications.

4.2 Brasilia Photo Show may use information from the participants collected during the festival for promotional or marketing purposes, including the use of participants’ names to advertise on printed and electronic vehicles and subsequent publications as described above for an indefinite period.

4.2.1 The participant hereby authorizes Brasilia Photo Show to disclose any interview, journalistic material, videos and photos of the exhibitions and the awards ceremony in which the participant has taken part.

4.3 The Participant hereby explicitly consents to the transfer and processing of his or her personal information and photos submitted, by Brasilia Photo Show and its affiliates, sponsors, supporters and business partners, sent via the festival registration, or information collected in the case of a prize award or classification, as described above or in the Brasilia Photo Show Privacy Policy referred to above (including the disclosure of such information or transfer thereof to jurisdictions that may not provide the same legal protection in the country where the participant is).

4.4 Participants and guests authorize for the purpose of publicizing the festival, the publication of photos, videos and interviews made at events promoted by Brasilia Photo Show, in which their images and testimonies appear.

5. DISCLAIMER OF LIABILITY

5.1 Brasília Photo Show Ltda is not responsible for any noncompliance with this offer, in which the failure is due to circumstances arising from unforeseeable circumstances or force majeure that are beyond its control. Such circumstances include, but are not limited to, the involvement of public entities, adverse weather conditions, fire, flood, war, earthquake, riots, labor conflicts, terrorism, religious acts, inoperative websites, social networks or events that may pose an obstacle to its correct execution.

5.2 Brasília Photo Show is not responsible for any entries received after the closing date for registration, July 16, 2018, or registrations made by other ways than the official website of the festival.

5.3 The legislation of Brazil applies to this festival and the parties agree to the exclusive jurisdiction of the courts of Brasília / DF, Brazil, renouncing all others, however privileged they may be.

5.4 Brasilia Photo Show reserves the right to modify, cancel or terminate the competition, taking into account unforeseen circumstances beyond its control. These may include but are not restricted to computer viruses, technical equipment failure, or denial of third party services that may affect the integrity and fairness of the competition. If one of these events above results in cancellation, BPS will make every reasonable effort to reimburse any registration fees already received. In case of wars, earthquakes or other natural disasters, BPS may not be able to refund any registration fee already received.

By registering the photograph at the festival, sending the image to the Brasília Photo Show database, the participant confirms that he has read, understood and accepts all the terms and conditions of this regulation.
